That's unfortunately too much of an open-ended question to give an answer. The CFI has a certain responsibility to cover and show proficiency in certain areas of operation as listed in FAR Part 61. However, the student pilot is "ACTing" as PIC during all solo ops and therefore has responsibility for the safety of the flight.
The NTSB will likely go through both the instructor's records and student's records and make a determination what caused the error. The instructor could take some or all of the blame if the regulations were not followed.
That's the administrative end. The real fact is that it is likely the CFI will be sued by the student's family regardless of the outcome of the NTSB report.
