Who's responsible for the rental costs?
I was working with an individual who was paid to provide his helicopter to me to take an FAA checkride in Oregon. I arrived in Seattle Washington to drive with him to Corvallis OR and fly his helicopter for the checkride. He was unable to provide his helicopter, but said that he had made arrangements for me to fly from Seattle with an acquaintance of his. I arrived at the hanger, was introduced to the instructor who would be flying with me and we left the next morning. Upon return to Seattle, the company presented the bill to the individual who setup the flight. He said he wouldn't pay, and to go to me for the bill. They sent me the bill, however I feel, that I never contracted with them, negotiated a price, or gave any information other than my first name. Am I liable for the bill $2,700

This is one of those areas’s where you need to consult a contract lawyer. There are certain things that must be met to have a contract. The first thing any lawyer is going to ask is what did you say. What did the pilot say and what documents rental agreement was signed and by whom.
You need to see a copy of the rental agreement and see whose it is between then take it to a lawyer. Only the parties listed on the contract should be involved. A requirements contract is a contract in which one party agrees to supply as much of a good or service as is required by the other party, and in exchange the other party expressly or implicitly promises that it will obtain its goods or services exclusively from the first party. Check the rental agreement it is a contract. I am not a lawyer and go not give legal advice and cannot. Just one man’s opinion. |
