Dear Community,
I received my CFI/CFII Certificate about a year ago and sitting at about 330 in total time, but have not been able to find employment yet. Not sure if I'm just not looking right or not but that's a different story. I still try to fly at least once a month to maintain some level of proficiency and for currency while holding down an unrelated job. I admit my sharpness on legal matters is not what it once was so I would like to see if I've overlooked anything in this matter.
The situation is I was approached today by someone asking me if I could fly them around for some pictures and potentially fly them across the state and back in the future. Of course being the first time being asked to operate in such a way left me speechless since I have of course had hope for this since I started my Student training, but understanding how easily it become a serious legal mess I explained in order for me to do this I need to do a little research to ensure the legality of this and I did offer the contact of where I rent from at the local airport for a more quality service. He declined the contact. Of course by my understanding if I were to go rent a plane and take him up, I could be in some good trouble as that would be an air carrier. Now if my understanding is correct on the following and I'm wrong or right please provide citation either way. If I'm not mistaken, it is permissible for me to give him the contact of the renting FBO and he may choose me or any other qualified pilot upon his own choice. Is this correct or is there a gotcha in the CFR 14?
Now secondly if it is permissible legally, what is the practicality of this happening since I've never attempted this before? I'm not terribly familiar with FBOs and insurance policies which I feel may play a big role in this. Do FBOs typically permit these types of operations? Does typical insurance that the FBO may have on the aircraft become void in such an operation? I've been border line on getting renters insurance probably through AOPA for a while now and this may push me to get it, but would typical renters insurance permit this type of operation? I've heard of FBOs having approved lists of commercial pilots that a person might select from. Is this list basically the FBOs employee list of insurance approved and checked out pilots?
I realize on demands carriers are there just for these types of services and to ensure a level of standards in these types of operations which I did explain to the guy, so I at least made the effort to get him in touch with one but again he declined. I see it as an opportunity for some free hours but of course the last thing I want to do is risk my licenses. Does anyone have experience or insight into this?
