Infraction
Recently received an infraction for: 23226. (a) It is unlawful for any driver to keep in the passenger compartment of a motor vehicle, when the vehicle is upon any highway or on lands, as described in subdivision (b) of Section 23220, any bottle, can, or other receptacle containing any alcoholic beverage that has been opened, or a seal broken, or the contents of which have been partially removed.
This is a zero point infraction (non moving) and possibly may be dismissed through traffic school. My question is: would be this considered an FAA reportable alcohol-related violation. |

Sorry to say Yes, under 14 CFR Part 61 now Part 120, you must report alcohol-related administrative actions, whether a conviction took place or not. Administrative actions and convictions are also reportable under Part 67, the airman application for a medical certificate.
Reference: Frequently Asked Questions Send the letter to: Federal Aviation Administration (FAA) Security and Investigations Division (AMC-700) P.O. Box 25810 Oklahoma City, OK 73125 Or Fax to (405) 954-4989 There is a sample notification letter on the web site above to fill in the blanks. Keep in mind you have 60-days to notify the FAA. |
